E1 교역인 비자
이번 칼럼에서는 E1 교역인 비자에 관해서 설명을 드리려고 합니다. 미국에서 사업을 하기 위해서 (혹은 그 회사의 직원으로서 일하기 위해서) 신청할수 있는 비자의 종류로 L1, E2, E1 등의 비자 종류를 생각해 볼수 있는데, 특히 사업의 성격이 한국과 미국 사이에 교역을 하는 사업을 하는 회사의 경우 E1 비자가 좋은 선택이 될수 있습니다. 여기서는 E1 비자를 받기 위한 조건과 L1 이나 E2 비자와의 차이점에서 대해서 살펴보고자 합니다.
E1 비자를 신청하기 위한 조건
- 미국와 비자 신청자의 국적 국가간의 조약
- 미국내에 있는 사업체의 국적이 비자 신청자의 국적와 동일할 것
- 미국내에 있는 사업체를 통해서 미국과 비자 신청자의 국적 국가간에 교역이 있어야 함
- 사업체의 전체 국제 교역 중 미국와 신청자의 국적 국가간의 교역이 적어도 50% 이상되어야 함
- 미국와 신청자의 국적 국가간의 교역이 지속적으로 빈번히 이루어져야 함
E1 비자는 E2 비자와 마찬가지로 신청자의 국적 국가와 미국 사이에 해당 조약이 있는 경우에만 신청이 가능한 비자 종류입니다. 한국은 미국과 해당 조약이 성립되어 있기 때문에 E1 비자 신청이 가능합니다. 역시 E2 비자와 마찬가지로 E1 비자 신청을 하기 위해서는 미국에 있는 사업체의 국적이 한국이어야 합니다. 이때, 사업체의 국적은 사업체의 소유주의 국적에 따라서 결정이 됩니다. 사업체의 50% 이상의 소유권이 한국 국적을 가진 사람에게 있어야만 사업체의 국적이 한국으로 인정이 되며, E1 비자 신청이 가능합니다. 단, 소유주가 미국 영주권을 가지고 있는 경우, E1 비자 신청 목적으로 영주권자의 한국 국적은 인정받지 못합니다.
E1 비자 신청을 위해서는 단순한 미래의 사업 계획이 아니라 이미 미국과 한국간의 교역이 존재해야 합니다. 아직 국가간 배송이 이루어지 않은 경우라면, 적어도, 이미 계약서가 체결되고 국가간 배송이 입박한 상태여야 합니다. 또한, 사업체의 전체 국제 교역 중에 한국와 미국 사이의 교역이 차지 하는 비중이 적어도 50% 이상이어야 하며, 교역이 이루어지는 물품의 가치 보다는 얼마나 자주 지속적으로 교역이 이루어지고 있느냐가 더 중요합니다.
회사의 사업의 주성격이 미국와 한국간의 교역이며 위의 조건들을 맞출수 있는 경우, E2 비자와 마찬가지로 회사의 50% 이상의 소유권을 가진 소유주가 교역인 자격으로 E1 비자를 받을수 있습니다. 또한, 한국 국적의 소유자에 한해서 이 회사의 이사급이나 관리자급, 혹은 꼭 필요한 기술을 가진 사람의 경우 직원으로서 E1 비자를 받을수도 있습니다.
그렇다면, E2 비자와의 차이는 무엇일까요? E2 비자를 받기 위해서는 투자금액의 액수와, 자금의 소유권과 출처, 미국 경제 기여도를 증명하는 측면에서의 회사의 소득 수준이나 직원 고용 상황들을 증명하는 것이 중요합니다. 그러나 E1 비자의 경우에는 한국와 미국간의 교역을 증명할수 있다면, 회사 운영을 위한 현금 투자나, 자금의 출처, 회사의 소득 수준등을 통한 미국 경제에 대한 기여도를 증명하는 것이 중요하지 않습니다. 물론, 이사급이나 관리자급 직원으로 E1 비자를 받는 경우에는 직책이 이사급이나 관리자급임을 증명하기 위한 측면에서 직원 고용 상황은 중요할수 있습니다.
L1 비자와의 차이점은 무엇일까요? L1 비자를 신청하기 위해서는 미국에 있는 회사와 한국에 있는 회사 사이에 자회사, 모회사, 제휴회사등의 관계가 있어야만 합니다. E1 비자 신청을 위해서는 L1 비자처럼 한국에 반드시 그러한 관계에 있는 회사가 있어야 할 필요가 없습니다. 또한, 직원 (주재원)으로 L1 비자를 받기 위해서는 비자 신청자인 직원이 한국에 있는 회사에서 비자 신청전 3년 동안 적어도 1년 이상은 일을 했어야만 하는데, E1 비자에는 이러한 조건이 없습니다. 한국에 있는 회사에서 근무한지가 1년이 넘지 않았거나, 혹은 한국에 있는 회사에서 전혀 일한 적이 없더라도 직원으로서E1 비자를 받을수 있습니다. 따라서, 회사의 사업 성격이 한국와 미국과의 교역인 경우, L1 이나 E2 비자보다 E1 비자가 훨씬 받기에 쉬운 비자 종류가 될수 있습니다.
